Disability types caused by traumatic brain injuries in Houston Texas

Traumatic brain injury (TBI) can result from many types of accidents – industrial accidents, slips and falls, sports injuries – but car and motorcycle accidents are the most common cause of brain injury in Houston.

Brain injuries can be temporary, like a concussion, or more serious and even result in permanent paralysis.

Whatever the nature of your injury, it’s important that after you have received the necessary medical attention, you or a loved one contact a brain injury lawyer who can fight for the compensation you deserve.

At DeHoyos Accident Attorneys, we have been representing families in the Houston area who have been affected by brain injuries from accidents on the roads and elsewhere.

What is a Traumatic Brain Injury?

A traumatic brain injury is caused by an abrupt trauma to the skull, such as a sudden blow or jolt that leads to the brain being damaged.

This is commonly experienced in vehicle collisions, as well as in contact sports, slips and falls, and industrial or construction-related accidents.

The severity of the damage to the brain is not always immediately evident and needs to be checked by a qualified medical professional. Problems with the brain and central nervous system must always be treated with great care.

Diagnostics can confirm the longer-term prognosis for recovery, ranging from mild and short-term effects to longer-term or even permanent and life-changing effects.
As well as affecting mobility and the ability to live a normal life, a traumatic brain injury can cause mental and emotional suffering.

Types of Head & Brain Injuries

Two broad types of head injury can lead to a traumatic brain injury:

Open Head Injury

This occurs when the skull is penetrated by an object that enters the brain tissue.

Often, when the skull is fractured by forceful impact, a fragment of bone can penetrate the brain tissue and cause brain damage. Other causes can be glass or any other sharp object that penetrates the skull.

This type of injury is immediately evident, usually involving swelling and bleeding and requiring urgent medical attention.

Closed Head Injuries

Closed head injuries are more difficult to diagnose as there may be no serious external signs of trauma, such as blood or swelling.

In these cases, nearly all the damage is internal. Such injuries are common in car accidents, where the head may strike the dashboard or steering wheel during a collision.

The most common closed head injuries include:

  • Coup-contrecoup injury – bruising of the brain caused by the brain colliding with the sides of the skull after a powerful impact in an accident
  • Diffuse axonal injury – this is where the connecting fibers in the brain known as axons are sheared by the violent movement of the brain inside the skull after a collision, often leading to loss of consciousness and permanent disability.
  • Concussion – a milder injury that usually lasts only for a day or two but may not be immediately apparent

Other closed head brain injuries include contusions (bruising of the brain), hemorrhage (uncontrolled bleeding in the brain), and hematoma (clotting of blood outside the blood vessels).

Should I Visit a Neurologist After a Car Accident

If you experience a blow to the head during a car accident in Houston, it is likely that the medical team on the scene will recommend that you get fully checked out at a suitable medical facility.

There is a chance you sustained concussion or a more serious closed head injury, even if there are no visible signs of damage.

If you are experiencing any behavioral signs of neurologic problems, part of your medical check may involve a visit to a neurologist, who specializes in injuries to the brain and central nervous system.

A neurologist will conduct a physical examination and may order imaging tests to pinpoint the cause of your symptoms. An electroencephalograph test (EEG) can detect electrical activity in your brain and help the neurologist assess brain function.

If you are diagnosed with a traumatic brain injury, you may be prescribed medication, bed rest, and/or another course of treatment depending on the extent of your injury.

Neurological Problems After a Car Accident

As well as the central nervous system, the peripheral nervous system includes nerves that link the brain and spinal cord to the rest of the body.

Either of these may be damaged in a car accident and cause neurological problems. Common complaints include:

  • Weakness
  • Numbness
  • Pain in the hands or feet
  • Dizziness

What Damages can you Claim from Brain Injuries?

In Texas, you can claim for damages that result from a car accident or other incident where somebody else is at fault.

If you can prove that another party was negligent or reckless, you (or your family) may be able to claim compensation for the following losses:

  • Medical bills for treatment you receive
  • Bills associated with rehabilitation you require
  • Mental health treatment costs
  • Out-of-pocket expenses directly resulting from the accident or your injuries
  • Pain and suffering caused by the injuries
  • Future pain and suffering likely to be caused by your injuries
  • Loss of quality of life
  • Any physical impairment you experience
  • Lost income and earning potential
  • Loss of companionship

To claim what you deserve can be extremely challenging because of three main obstacles:

  1. It is difficult in the aftermath of an injury to think clearly about the losses or potential losses you suffer
  2. Proving some of the above losses is difficult, especially those related to emotional or mental suffering and future losses
  3. The insurance company may seek to deny, delay, or challenge your claim
